Terms and conditions

PhotoVision believes in exceeding customer expectations by delivering superior standardised customer service delivery systems, allowing customers the customisation and ownership on style, variety and diversity in their digital photographic images.


THE CLIENT

1. I/we authorise PhotoVision to arrange the photography in accordance with the details stated on the on-line booking form.  I/we are satisfied that these details are correct.


2. The booking fee is not refundable but may be transferable.  Clients can reschedule up to 24 hours prior to the booked date by notifying PhotoVision by email or telephone to arrange an alternative date and time without incurring any additional costs.


3. I/we have received, read and understand PhotoVision’s price list, which has been confirmed for our assignment on payment of the deposit/booking fee.  We agree that payment of the initial deposit/ booking fee confirms the booking with PhotoVision as per the details shown on the on-line booking form.  All bookings for photography assignments require a minimum 50% deposit at time of booking, payable to PhotoVision. If you have a voucher code valid for your order, please enter the code. It will be verified online and the discount will be credited to your order total. The type of discount will be displayed on the bottom line, next to the total.


4. I/we agree to pay the full balance on the day of our assignment.  Failure to do so gives PhotoVision the right to refuse to carry out the full photographic service.


5. The booking of and any additional costs incurred for booking venues, photography locations etc are our responsibility.


6. To avoid disruption to the photographic coverage and to allow PhotoVision to fulfil its contracted duty, other photography by family and friends will be at the discretion of PhotoVision’s photographer.


7. I/we agree the copyright in all photographs is owned by PhotoVision.  I/we also acknowledge PhotoVision may grant to the photographer a non-exclusive license to the use any of images of our sitting for reasonable general promotional advertising for the photographer.


8. Subject to the payment of the full fee, PhotoVision hereby grants the client unlimited reproduction rights to the specified number of digital photos as per the package ordered for personal (non-commercial) use.


9. PhotoVision has no control over the environment in which the digital photos are viewed and downloaded from the website. Image quality and resolution will vary depending on individual screen quality and resolutions and download speeds will vary depending on the internet connection of the individual.


10. I/we understand the image quality of the digital photos downloaded directly from the site are to a maximum size of 6” x 4” and a resolution of 250PPI. At this size and resolution, I/we understand the maximum size we can print a quality photo is 6 inch by 4inch (15cm x 10cm).  Anything larger than this size will likely be blurry.


11. I/we agree to indemnify PhotoVision in respect of any claims or damages or any loss or costs arising in any manner from the reproduction of any images supplied to the client by PhotoVision.


12. The digital image files remain the property of PhotoVisiond will be kept on file for a period of 2 years for re-orders.


Regarding re-ordering of photographs, I/we also understand:

13. Orders must be placed within 7 days of the digital photos becoming available on the web site, otherwise prices current at the time of ordering will apply and I/we will pay all reasonable freight and postage that I/we request.


14. All orders must be accompanied by full payment.


15. PhotoVision has no control over the environment in which the printed photographs are kept and that colour photographs, in common with all sensitised material and colour dyes, have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources.  Photographs will last longer if displayed under better lighting conditions.


16. Our Return Policy is assessed on an individual basis. All products are quality control checked before packaging. All products are carefully packed in the appropriate packaging for distribution. If a product is damaged during transit please email us immediately upon discovery of damaged goods and we will asses the best, fastest and appropriate action to fix the situation. We want our customers to receive the highest quality service and products we can offer.


17. When you place an order you will receive an e-mail with confirmation of your order details and receipt. Within 14 working days, your order will be dispatched. All orders will be delivered to your nominated address.

For our prints and selected gifts we use Australia Post and our customers receive their orders in their letterbox generally within 1-2 days of dispatching and our sturdy packaging ensures your prints arrive in perfect condition.

For our framed prints and selected gifts we use local courier operators, requiring signed receipt of delivery. Our sturdy packaging ensures your framed prints and gifts also arrive in perfect condition.


PHOTOVISION

1. Should the nominated photographer not be available for any reason, PhotoVision will notify the client of the change as soon as it is known and reschedule with the nominated photographer or provide another photographer with equivalent skills.


2. The price quoted will be guaranteed for seven (7) days otherwise the current price will be confirmed when the deposit on the order is paid.  Any additional costs will be advised and confirmation required before proceeding.


3. PhotoVision shall carry out this assignment with due and professional diligence.  Elements beyond PhotoVision control include faulty material, equipment failure, damaged or corrupted digital files, loss of digital files in transit between PhotoVision and professional laboratories and internet providers employed by PhotoVision, industrial disputes, civil disturbances or weather conditions which may inhibit or prevent PhotoVision completing in whole or in part this assignment.  In this case, PhotoVision shall not be liable for its complete performance of the assignment.


4. It is agreed that the liability of PhotoVision shall be limited to be a refund of any monies paid under this agreement which shall be in full and final satisfaction of any damage or loss suffered.

PhotoVision is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. PhotoVision is not responsible for the privacy statements or other content on Web sites outside of the PhotoVision and PhotoVision family of Web sites.

Use of your Personal Information

PhotoVision collects and uses your personal information to operate the PhotoVision Web site and deliver the services you have requested. PhotoVision also uses your personally identifiable information to inform you of other products or services available from PhotoVision and its affiliates. PhotoVision may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

PhotoVision does not sell, rent or lease its customer lists to third parties. PhotoVision may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, PhotoVision may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to PhotoVision, and they are required to maintain the confidentiality of your information.

PhotoVision does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

PhotoVision keeps track of the Web sites and pages our customers visit within PhotoVision.com.au, in order to determine what PhotoVision services are the most popular. This data is used to deliver customized content and advertising within PhotoVision to customers whose behaviour indicates that they are interested in a particular subject area.

PhotoVision Web sites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on PhotoVision or the site; (b) protect and defend the rights or property of PhotoVision; and, (c) act under exigent circumstances to protect the personal safety of users of PhotoVision, or the public.
